# Copyright and Illegal Content: Notices and Action

## 1. Our approach {#approach}

1.1 The Workshop hosts maps and comments posted by players. We do not check everything before it appears, but when we
learn that content is illegal or infringes someone's rights, we act quickly: we remove it or turn off access to it.

1.2 This page explains how to report such content, what we do and how fast, how uploaders can respond, how strikes work
and which records we keep. It follows the EU Digital Services Act (Regulation (EU) 2022/2065, "DSA") and, for rights
holders who rely on US law, the notice and counter-notice procedure of the US Digital Millennium Copyright Act ("DMCA",
17 U.S.C. § 512).

1.3 The Workshop is free, carries no advertising and sells nothing, so it is not run for a profit-making purpose. It
therefore does not operate as an "online content-sharing service provider" under Article 17 of Directive (EU)
2019/790 and does not rely on that regime. We act on notices as described here.

## 2. How to send a notice {#send}

2.1 **Online form (preferred):** https://blocky-music.qwu.world/legal/notice. You do not need an account. The Report
menu on every map and comment also links to it ("I own the rights / legal complaint").

2.2 **E-mail or post:** dragon4ik.QwU@gmail.com, or the postal address in section 17. We enter e-mailed and posted notices
into the same system and handle them the same way.

2.3 One notice can list up to 200 locations. If you have more, send several notices or e-mail us. If the form asks you
to wait because of its rate limits, e-mail us instead.

2.4 A normal report through the Report button (for example "may be used without permission") is not a legal notice.
Staff review it under the rules. If you hold the rights, use the notice form.

## 3. What a notice must contain {#requirements}

### 3.1 Every notice {#requirements-all}

(a) **Where the content is:** the exact Workshop link or links, and which part is affected (audio, cover, chart,
description, comment or profile). Links to map files, covers and previews on the Workshop are fine, including links to
maps that are hidden from guests.

(b) **Why it is illegal or infringing,** explained clearly enough for us to see the problem.

(c) **Your name and e-mail address.**

(d) **A statement** that you believe in good faith that the information and claims in the notice are accurate and
complete.

A notice with (a) to (d) is complete. We decide it on its merits.

### 3.2 Child sexual abuse material {#requirements-csam}

Only (a) and (b) are needed; your name, e-mail and signature are optional. Give us only the Workshop link. Do not copy,
download, attach or forward the material. You can also report it to Dyżurnet.pl (https://dyzurnet.pl), the Polish
hotline for illegal content online, or to the police.

### 3.3 Copyright notices under US law (DMCA) {#requirements-dmca}

For a copyright notice to be handled as a DMCA notification, it must also contain:

(e) identification of the copyrighted work or works, for example the title, the artist or owner and a link to the
official release (for many works, a representative list is enough);

(f) your postal address and phone number;

(g) a statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the
law;

(h) a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or
are authorised to act on the owner's behalf; and

(i) your physical or electronic signature (typing your full name is enough).

The form also asks you to confirm that you considered whether the use could be licensed or covered by an exception such
as fair use, quotation or parody.

A copyright notice without (e) to (i) is still decided under EU rules if it has everything in section 3.1. The uploader
then responds through an appeal instead of a DMCA counter-notice.

### 3.4 Incomplete notices {#incomplete}

If something from section 3.1 is missing, we tell you what is missing (by e-mail, and on your private case page) and
wait for it. We never silently drop a notice. Submissions our spam protection flags are checked by a person.

## 4. What happens next, and how fast {#timeline}

People make every decision. If automated tools helped, for example by finding identical files, the decision says so.
US business days are Monday to Friday, except US federal holidays.

## 5. What we can do {#actions}

We act only on the part that is affected, where that is possible:

- **Remove the audio.** The map stays, but players need their own copy of the song. Previews are deleted.
- **Remove the cover.** A placeholder cover is shown.
- **Turn off downloads.** The map page stays, but downloads and previews stop, the map leaves the listings and its
  comments are locked.
- **Hide or delete** a description, comment or profile content.
- **Delete the map,** for illegal content beyond copyright. See section 12 for how files are handled.
- **Block the file** so that the identical audio cannot be uploaded again, and review other maps that host it (section 8).
- **Reject the notice** when the content is not illegal or infringing, or the notice does not show that it is.

## 6. What the uploader is told {#uploader}

6.1 The uploader receives a statement of reasons: what we did, where and for how long; the facts, including that it
followed a notice; whether automated tools were involved; the legal ground or the rule; the case reference; their active
strikes; and how to respond.

6.2 **What we share about you.** For copyright notices, the uploader sees your name or organisation, the works, the
locations and your explanation. For all other notice types, the uploader sees nothing that identifies you. Your e-mail
address, postal address and phone number are never shown to the uploader.

6.3 If an authority asks us not to inform the uploader, for example because of a criminal investigation, we do not, for
as long as that request applies.

## 7. Maps already installed, and Minecraft servers {#installed}

7.1 We cannot and do not delete files from players' computers. The mod marks a map as withdrawn when it next checks the
Workshop.

7.2 Once a map is withdrawn or its audio removed, installed copies may be used only for personal play. The mod stops
offering them to servers and other players, and it does not share any Workshop map it has not been able to check within
the last 7 days. Servers that check the Workshop hide withdrawn maps from votes. Server operators must stop sharing
withdrawn maps ([Workshop Terms](/legal/terms#servers)).

## 8. The same file elsewhere, and staydown {#staydown}

8.1 When we remove audio because of a copyright notice, we add that exact audio file to a blocklist. New uploads of the
identical file are refused.

8.2 We then review other maps that host the identical file. If there is no valid basis for that copy, its audio is
removed too. The uploaders of those maps get a statement of reasons, but no strike unless a notice names their map.

8.3 When an artist asks not to have their music on the Workshop, uploads naming them are refused and existing maps are
reviewed the same way ([Content Usage](/rules/content-usage#for-artists)).

8.4 A refused upload also comes with a statement of reasons you can appeal, for example if you are the artist or hold a
licence. After a person reviews it, staff can allow your file.

## 9. Counter-notices {#counter-notice}

### 9.1 When to use one {#counter-when}

If your content was removed because of a DMCA notification and you believe this happened by mistake or because the
content was misidentified, you can send a counter-notice. If you simply have a licence or permission, the route in
section 10 is usually faster.

### 9.2 How to send one {#counter-how}

- through the link in your statement of reasons (it works for 6 months, even if you cannot sign in), or on the website
  while signed in; or
- by e-mail to dragon4ik.QwU@gmail.com or by post to the address in section 17, with the case reference.

**Before you start:** everything in a counter-notice, including your full name, postal address, phone number and e-mail,
is sent to the person who filed the notice, who may use it to take legal action against you.

You must be 18 or older, or be the uploader's parent or legal guardian filing on their behalf (then your own details are
used). If neither applies, use the route in section 10 instead.

### 9.3 What it must contain {#counter-requirements}

(a) the case reference, and identification of the removed content and where it was before it was removed;

(b) a statement, under penalty of perjury, that you believe in good faith that the content was removed or disabled as a
result of a mistake or misidentification;

(c) your full name, postal address, phone number and e-mail address;

(d) a statement that you consent to the jurisdiction of the US federal district court for the judicial district where
your address is located or, if your address is outside the United States,
the courts of Poland, and, where a United States court is required for a counter-notice, the United States District Court for the Central District of California, and
that you will accept service of legal process from the person who sent the notice or their agent; and

(e) your physical or electronic signature (typing your full name is enough).

### 9.4 What we do with it {#counter-process}

1. When the counter-notice is complete, we record when we received it and confirm this to you with the restoration dates.
2. Within 2 US business days, we send a copy to the person who filed the notice and tell them that we will restore the
   content between 10 and 14 US business days after we received the counter-notice, unless they first tell us that they
   have filed a court action to stop the uploader's alleged infringement.
3. If no such court action is reported by the end of that period, the content is restored automatically, the strike is
   removed, and both sides are told. The only exception is content that also breaks another rule; we then explain why it
   stays down.
4. If a court action is reported, the content stays unavailable until the matter is resolved.
5. If the counter-notice is incomplete, we tell you what is missing. The time limits start only once it is complete.

## 10. The faster route: show your licence {#licence-evidence}

Appeal the decision from Account, Standing, and include the licence, the permission or proof that the music is yours.
This route works for any removal, including those under section 3.1 and for uploaders under 18. If the evidence clearly
covers the use, we restore the content, remove the strike, and tell the person who filed the notice that the content was
restored and why, without your contact details. If the evidence is disputed, you can still send a counter-notice.

## 11. Strikes and repeat infringers {#strikes}

11.1 A strike is added to the uploader's account when we remove a map's audio or cover, or turn off its downloads,
because of a copyright notice.

11.2 Removals based on notices we receive before we send you a strike statement count together as that one strike,
however many maps or notices they involve.

11.3 A strike expires 12 months after the removal. It is removed earlier if the content is restored after a counter-notice
or an appeal.

11.4 With 2 active strikes, you cannot upload maps or new versions for 30 days. With 3 active strikes, you can no longer
upload. You can still browse, download, play, comment and rate.

11.5 These limits apply automatically, and an admin reviews each one within 72 hours. When a strike is removed or expires,
any limit it caused is lifted if you are back below that threshold.

11.6 Forged permissions or licences, and uploading ripped albums, end upload access immediately.

11.7 Uploading through another account or another Minecraft account after losing upload access is evasion and is
sanctioned ([Moderation](/rules/moderation#ladder)).

11.8 Every strike statement shows how many strikes are active and what happens at the next one.

## 12. Child sexual abuse material, terrorist content and threats {#serious}

12.1 **Child sexual abuse material.** Any moderator or admin disables it immediately. We delete generated copies such as
previews and thumbnails, lock the original files away where nobody, including staff, can view or download them, and
report the case to Dyżurnet.pl or the Polish police. We keep the locked files only as long as needed for that report:
90 days by default, or longer if an authority requires it. They are never included in normal backups. Accounts that upload
such material are permanently restricted.

12.2 **Terrorist content.** Disabled as soon as staff see a notice. Removal orders from EU authorities under Regulation
(EU) 2021/784 are carried out within 1 hour of receipt.

12.3 **Threats to life or safety.** When we learn of information that suggests a criminal offence threatening someone's
life or safety, we inform the police or the competent authority of the country concerned without delay. If we cannot
tell which country, we inform the Polish authorities or Europol.

12.4 Other serious illegal content, such as publishing someone's personal data, is handled the same way where needed:
the files are locked away and not kept in normal backups.

## 13. Orders from authorities {#orders}

We follow orders from EU and national authorities to act against illegal content or to provide information, as the DSA
requires. We tell the authority what we did and when, and we inform the affected user with reasons unless the order says
we must not. See section 17 for the point of contact.

## 14. Misuse {#misuse}

- Knowingly false notices or counter-notices can make the sender legally liable (for example under 17 U.S.C. § 512(f)).
- Users who repeatedly upload clearly illegal content lose upload access and can be sanctioned further.
- If someone often sends clearly unfounded notices, we warn them. After the warning we may handle their notices with lower
  priority for a reasonable period. Notices about clearly illegal content are always handled.

## 15. Other kinds of claims {#other-claims}

- **Trademarks, impersonation, personal data, defamation and other illegal content:** use the same form and choose the
  type.
- **A copied chart or map:** if you made the original chart, use the form and choose copyright. An obvious duplicate
  upload can also be reported with the normal Report button.

## 16. Records we keep {#records}

  handled through the notice form and the address above, wherever the rights holder is based.
